BluePeak Funding operates a business financing platform that connects businesses seeking capital with funding partners. We facilitate the application, review, and matching process. BluePeak is not a direct lender. All funding is provided by third-party lending partners subject to their own terms, conditions, and approval criteria.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Be authorized to act on behalf of the business applying for funding
• Provide accurate and complete information

3. Account Registration

Certain features of our Services require account registration. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Applications and Funding

By submitting an application through our platform:

• You authorize BluePeak to review your submitted documents and information
• You authorize us to share your information with our funding partners for the purpose of evaluating your application
• You understand that submitting an application does not guarantee approval or funding
• You represent that all information and documents provided are accurate and authentic
• You acknowledge that funding terms are set by our lending partners, not by BluePeak

5. SMS/Text Message Communications

By providing your phone number and opting in, you consent to receive SMS/text messages from BluePeak Funding. Full terms governing SMS communications are available in our SMS Terms & Conditions.

• Message frequency varies
• Consent is not a condition of service

6. User Conduct

You agree not to:

• Submit false, misleading, or fraudulent information
• Submit forged, altered, or falsified documents
• Use the Services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Impersonate any person or entity
• Scrape, crawl, or use automated means to access the Services

7. Intellectual Property

All content, features, and functionality of our Services — including text, graphics, logos, software, and design — are owned by BluePeak Funding LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BLUEPEAK DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC FUNDING OUTCOMES OR APPROVAL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEPEAK FUNDING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

11. Indemnification

You agree to indemnify and hold harmless BluePeak Funding LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your submission of false or fraudulent information.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the courts located in New York.

We reserve the right to modify these Terms at any time. Changes are effective upon posting. Your continued use of the Services constitutes acceptance of the updated Terms.
